EU court adviser says Google Gemini may infringe news copyright

Briefing by News4U · First published

An adviser to the European Union's top court said Tuesday that Google's Gemini chatbot may infringe publishers' copyright when it pulls news articles to answer user questions in certain cases. Advocate General Maciej Szpunar's non-binding opinion concerns a Hungarian suit by Like Company and warns that answers can violate reproduction rights if Gemini bypasses paywalls or reuses identifiable wording, while bare facts remain unprotected. He also said training large language models on copyrighted text can be allowed under existing text-and-data-mining exceptions. EU judges often follow such advice. [1]
