OCC finalizes GENIUS Act rules for stablecoin issuers, reserves and yield ban

Briefing by News4U · First published

The OCC issued final rules Wednesday implementing the GENIUS Act for stablecoin issuance, reserves and custody, effective January 18, 2027.

The Office of the Comptroller of the Currency finalized rules Wednesday for payment stablecoin reserves, redemptions and custody, requiring issuers to maintain reserves equal to outstanding stablecoins and process redemptions within two business days. The rule applies to national banks, federal savings associations, federal branches and nonbank firms seeking federal qualified issuer status. [1] [2]

Issuers are banned from paying yield or interest solely for holding, using or retaining stablecoins, and existing rewards programs must seek case-by-case approval. The OCC dropped proposed presumptions against affiliate arrangements but retains authority to act against evasion. [1] [2]
